PS2 - Activision Being Sued For Guitar Hero
While Guitar Hero III: Legends of Rock is making waves in sales everywhere, Guitar Hero Encore Rocks the 80s is facing some controversy. Rock band The Romantics is reportedly suing Activision, the game's publisher, for including their song “What I Like About You”, which was recorded by artists that sound very much like the band.
The suit was filed on November 20 in federal District court in Detroit. The suit states that the band who re-recorded their song improperly imitated their sound, and thus confusing the consumers into thinking that it was actually the band who recorded the track and endorsed the product.
And as the law in United States exist that serves to protect the right to publicity, which includes not using a person or persons identity for commercial purposes, especially without their knowledge.
Listed as plaintiffs for the suit are the Romantics which include Master Beat, Wally Palmar, Mike Skill and Coz Anler. Meanwhile being the developers, publishers and distributors of Guitar Hero, Activision, Harmonix Music Systems and RedOctane were listed as defendants.
Aside from enjoining further distribution of the game, the members of The Romantics also want compensatory and punitive damages for a yet unspecified amount.
The defendants have not given their statements yet with regards to this.
