PS3 - Gibson Suing Activision, Retailers Regarding Patent Infringement
Gibson Guitar has been making some waves of late claiming Activision infringed on a patent of theirs from 1999 for a music- based game that uses a guitar shaped controller.
Activision has since countered the claim, saying by waiting three years before saying anything permission was implied to be given and Gibson had no problems with it before until being informed the marketing and support deal with Gibson wasn't being renewed for future games.
Gibson has since expanded their claim to include retailers who are selling the game including Wal-Mart, Amazon, Target, K-Mart, Gamestop and Toys R Us, among others. According to reports, Gibson's claim their company "has been damaged and will continue to be damaged by the aforesaid infringement unless defendants are enjoined, preliminarily and permanently, from selling and offering for sale infringing products ...".
